Tree Removal In New Lenox: 21 Days, Or Seven

New Lenox puts a deadline on a bad tree. Section 98-41 makes it “unlawful for the owner of any premises in the village to permit any tree” to remain if it is diseased, infested or hazardous, and once notice goes out, § 98-43 gives the owner 21 days to treat or remove it — or seven days if an arborist finds imminent danger. Seven days is short, so if a notice arrives, call about the tree removal New Lenox requires right away.

Chapter 98: How New Lenox Handles Problem Trees

The rules sit in Chapter 98, “Vegetation.” Article III, Trees, runs from a purpose statement in § 98-37 through inspection (§ 98-39), the public nuisance declaration (§ 98-40), notice (§ 98-42), removal by the owner (§ 98-43), enforcement (§ 98-44), removal by the village (§ 98-45) and state enforcement under the Insect Pest and Plant Disease Act (§ 98-47). Enforcement under § 98-44 can be an administrative ticket, village removal with the costs charged to the owner, or both, and § 98-45 says abatement costs “shall be considered a debt owed to the village,” which can become a lien if unpaid. We found no fine amount or per-inch charge in the article.

Section 98-37 states a purpose of promoting the maintenance and survival of desirable trees but sets no preservation requirements, and searches of the code for tree removal turned up no private-tree removal permit; we could not confirm that none exists, so ask the village if the tree is large and healthy. Parkway planting is set by § 98-2: “Trees shall be planted halfway between the curb and sidewalk, no less than 30 feet apart,” at least 2½ inches in caliper “measured six inches above grade,” and “chosen from the following list,” which includes Autumn Blaze, State Street Maple, Red Maple, Hackberry and Patriot Elm. Section 98-2 does not say who owns a parkway tree or whether trimming one needs a permit. For species notes on that list, University of Illinois Extension is a good reference.

New Lenox registers contractors by ordinance. Section 18-253(a) says “No person shall be a contractor within the village without first having obtained a certificate of registration.” The § 18-251 definition lists “landscape contractors” and ends with “all other contractors,” without naming tree services. The annual fee is $150.00 under § 18-259; § 18-255 requires a bond “in the penal sum of $10,000.00”; § 18-256 requires “general liability, $500,000.00 single limit” that cannot be canceled without “90 days’ prior written notice to the village”; and § 18-257 sets workers’ compensation at $500,000 each accident and $500,000 for disease. Under § 18-258, registrations expire on the anniversary of issuance. Ask any contractor, Pro Tree included, for the certificate and the insurance behind it.

Hickory Creek And The 1829 Trading Post

In 1829, fur traders Aaron Friend and Joseph Brown set up an outpost on the north side of Hickory Creek, and the Hickory Creek State Nature Preserve carries the creek’s name today. New Lenox Township was established in 1852. The village, named after Lenox, New York, incorporated on October 4, 1946, sits in central Will County and calls itself “The Home of Proud Americans.” Its 2020 census count was 27,214.

Emerald ash borer was already in New Lenox parkways by 2012. A 2012 Patch report said the village was removing infested parkway trees at no charge while trees elsewhere on a property had to be handled by a private service; through May 14 of that year the village had removed 75 trees, with $15,000 set aside for removal and a 50/50 replacement program. Ash elsewhere on a lot was left to the owner, and a dead or infested ash is the kind of tree § 98-41 reaches.

Storm damage. If wires are involved, call 911 and then your electric utility before anyone approaches the tree. A tree split by wind can fall under § 98-41 as hazardous, so do not wait for the notice.
