Beecher’s Tree Regulations, Section By Section

Title 8, Chapter 1, “Tree Regulations,” was adopted by Ord. 1185 on April 22, 2013. Public trees are covered by § 8-1-8, which applies to “any trees standing on any street, avenue, sidewalk, public right of way, or public grounds in the village.” Removing one requires a permit and “approval by the village’s streets and alleys committee.” The applicant deposits “the sum of three hundred dollars ($300.00)” in escrow and replaces the tree “with another tree of at least two inch (2″) caliper”; the escrow is forfeited if the replacement is not in within six months, and the village board may waive these requirements. Section 8-1-2 keeps the village’s right to plant, prune, maintain and remove public trees and to remove “any tree or part thereof, which is in an unsafe condition.”

Owners have clearance duties under § 8-1-4: a “clear space of eight feet (8′) above the surface of the street or sidewalk,” no branches that “obstruct the view of any street intersection” or “obstruct the light from any streetlamp,” and removal of “all dead, diseased, or dangerous plantings or broken or decayed limbs which threatens the safety of the public.” Section 8-1-3 makes it unlawful “as a normal practice” to top a street tree or other public tree, meaning cutting limbs back to stubs larger than 3 inches in diameter. Penalties are in Title 8, Chapter 9: under § 8-9-1, as amended by Ord. 1435 in August 2025, violators are “fined not less than one hundred dollars ($100.00) nor more than seven hundred fifty dollars ($750.00),” with each day a separate offense. The village sits at the center of Washington Township in Will County and had 4,713 residents in 2020. A branch of Trim Creek runs through town, though it usually carries very little water.
