Chapter 25 Stops At Your Property Line

Article 1 of Chapter 25 runs from 25-1-1 to 25-1-8. Section 25-1-4 reserves a long list of acts on Village trees. Only the Forester, an agent of the Forester or a Village contractor may perform them. The list covers planting, spraying, injecting, fertilizing, pruning, removing or disturbing. It also covers volcano mulching, placing containers, damaging or cutting, attaching objects, and making tree wells or curb cuts. All of it needs written approval. The Forester must respond within seven days, and approval then permits work within thirty days. There is no caliper threshold anywhere in the section — size is irrelevant, ownership is everything.

One private-property obligation does survive. Felling a private tree that may fall onto Village property requires a liability policy. That means $1,000,000 bodily injury and $2,000,000 property damage. Section 25-1-5 gives owners thirty days after certified notice. After that, the Forester may abate a nuisance and lien the cost. Section 25-1-8 also adds ISA-valued replacement for injury to a Village tree.
