Section 58-78(c) is the one homeowners meet. No contractor or property owner shall remove a parkway tree, for construction or for any other reason, without first filing an application and procuring a permit from the village manager. The same section requires replacing what came out — a minimum caliper of two inches diameter, of an approved species. Section 58-78(b) commits the village to replacing parkway trees it takes out for sidewalk repaving or street widening. Section 58-79 sets the private duty: sixteen feet of clearance above streets, ten feet above sidewalks. Ten days to comply, and the cost is assessed against the property on failure.

Then the penalty, at 58-45, unlike anything nearby: a violation is “guilty of a misdemeanor, and upon conviction thereof shall be fined a sum no less than $5.00 nor more than $5,000.00, or may be imprisoned for a term not exceeding 60 days, or both.” All penalty fees collected are forfeited to the tree bank.
