Tree Trimming and Removal in Wayne

Tree Removal In Wayne Reaches The Backyard

Wayne’s tree chapter does not stop at the curb. Section 11-9-4(A) applies it to all property in the village, owner-occupied single-family homes included, and § 11-9-4(C) requires a village permit before trees are removed from the 20 feet nearest any lot line — the streetscape preservation area in front and corner side yards, and the tree preservation area along interior side and rear yards — or before any heritage tree comes down, which § 11-9-3 defines as 25 inches DBH or larger. On a lot of one to three acres, that perimeter holds a lot of trees. The permit costs $75 under § 11-9-4(M), refunded if the village engineer finds the tree dead, dying, diseased or a noxious species, and it is the first line item on any tree removal Wayne job we quote.

Title 11, Chapter 9 In Practice

The chapter dates to Ordinance 04-01, adopted February 17, 2004. Besides the preservation areas and heritage trees, § 11-9-4(C)(1) requires a permit to remove trees or vegetation from a conservation area, from property under a development petition, from a village right-of-way or other village property (unless the village is doing the work), from utility easements, and from a floodplain or floodway as defined by DuPage or Kane County. Under § 11-9-4(C)(2), no permit is needed to prune or remove a tree the village determines is hazardous under § 11-9-16.

The village engineer issues permits under § 11-9-4(D) where a tree is dead or dying, diseased, where removal fits good forestry practice, or where refusing would deny all reasonable use of the property. Otherwise, removal may still be allowed if it is offset by double inch-for-inch replacement. Planting in a village right-of-way needs the engineer’s prior written approval and a hold-harmless agreement on file.

The penalty section, § 11-9-13, as we read it, sets a fine of up to $750 per violation for an unpermitted removal and treats each inch of trunk diameter as its own violation, so a 20-inch tree can mean 20 counts; each removed tree must also be replaced, with replacements at least three inches DBH. Tree-fencing violations carry up to $500 a day. If you need help choosing what to plant back, The Morton Arboretum publishes species guidance worth reading first.

Contractor licensing in Wayne. We did not read the village’s business-regulation title, so whether Wayne licenses or registers tree contractors could not be confirmed. Village Hall can answer that. What the tree chapter does say is that the village may act without prior notice on non-village property in an emergency when a certified arborist determines a tree poses an immediate hazard. Ask any contractor for proof of insurance before work begins — that includes us.

Wetlands, Ponds And Horse Country

Wayne incorporated in 1958 and spans two counties: Wayne Township in DuPage and St. Charles Township in Kane. Its 5.82 square miles lie between the DuPage and Fox rivers and are dotted with small streams, wetlands and ponds; Brewster Creek in Pratt’s Wayne Woods is the site of a major wetland restoration program. That wet ground is why the floodplain permit in § 11-9-4(C) matters here, and why trees near low spots deserve a closer look at the root flare before anyone calls them sound.

It is also horse country. Most subdivisions are zoned for lots of one to three acres, and in the late 1800s Mark Dunham’s Oaklawn Farm made Wayne a center of Percheron horse breeding; Dunham Castle went up between 1878 and 1882, and the area around Army Trail and Dunham roads joined the National Register of Historic Places in 1979. The chapter’s own stated purposes include to “preserve historic and rural streetscapes” and “minimize erosion and storm water runoff,” and an old tree line along a country road is exactly what those buffers keep in place.

How We Work In Wayne

  • Tree and bush removal — permit pulled first inside the 20-foot preservation areas and for any heritage tree
  • Trimming and pruning — clearance over drives, paths and roads on large lots, without stripping the streetscape the code protects
  • Stump grinding — ground down so a three-inch replacement tree can go back in the same area
  • Storm response, 24 hours a day

Storm damage. If wires are involved, call 911 and then your electric utility before anyone approaches the tree. A storm-broken tree the village finds hazardous under § 11-9-16 needs no removal permit, so get that determination on record before cutting inside a preservation area.

Every tree removal Wayne request gets the same first question from us: where on the lot does the tree stand. Tell us roughly where the tree stands relative to your lot lines and how big the trunk is; those two numbers settle most permit questions here.
