Title 8, Chapter 9 In Practice

Away from the creek, Chapter 9 of Title 8 deals mostly with public ground. Section 8-9-1(B) makes it “unlawful to remove or cut down any tree or shrub in any street, parkway or other public place” without a permit, applied for through the Director of Community Development, and § 8-9-1(A) requires a permit to plant there as well. Section 8-9-3 bans injuring a tree in a public place or attaching “any sign, advertisement or notice” to one, and § 8-9-2(A) requires the Director’s permission before anyone ties a wire or rope to a tree. The permit section lists no fee, and we found no permit for removing a tree from an ordinary private yard in this chapter; the village can confirm whether one applies under another title.

Owners carry two duties under § 8-9-4. A tree that overhangs a sidewalk or street “in such a way as to impede or interfere with traffic or travel” must be trimmed by the owner of the abutting premises “so that the obstruction shall cease,” and “any limb of a tree which has become likely to fall on or across any public way or place” must be removed by the owner. Section 8-9-6 sets a fine of $50 to $750 for each offense, and every day a violation continues counts on its own. Settled in 1834 by New England farmers and incorporated in 1956, Elk Grove Village had 32,820 residents in 2020. Busse Woods, 3,558 acres, lies north of the village, and Salt Creek runs through its center. Cook County’s 2024 hazard mitigation annex lists the village as a Tree City USA, with a date of 1987, and records 8.74 inches of rain in Elk Grove on September 12, 2008 and flooding in the industrial park in 2001.

The annex lists wind storms on August 23, 2007 and June 24, 2013, and a July 4, 2022 high-wind event near Landmeier and Lively that left several buildings with roof damage. A creekside tree spends much of the year in soil that loses its grip when saturated, and wind strong enough to lift roofing is strong enough to tip one over by the root plate.
